Terms and Conditions

1. Introduction

1.1. These Terms and Conditions ("Terms") govern your access to and use of the website, mobile site, mobile applications, and related services (collectively, the "Platform") operated by OfficeFnD ("Company", "we", "us", "our"), an office space discovery and booking aggregator based in India.

1.2. By accessing, browsing, registering on, or using the Platform in any way (including viewing listings, creating an account, listing a space, submitting enquiries, or making a booking), you ("User", "you", "your") agree to be bound by these Terms, our Privacy Policy, and any other policies displayed on the Platform..

1.3. If you do not agree with these Terms, you must not access or use the Platform.

1.4. These Terms apply to:

(a) End Users / Clients searching, enquiring, or booking office spaces, coworking spaces, managed offices, commercial offices, meeting rooms, conference rooms, training rooms, and virtual offices through the Platform; and
(b) Workspace Providers / Space Owners / Operators listing or offering their workspaces for discovery or booking through the Platform.

2. Definitions

For the purpose of these Terms:

2.1. "Platform" means the website and/or mobile applications operated by OfficeFnD, including all related tools, interfaces, and services.
2.2. "User" / "Client" means any individual or legal entity that visits, accesses, or uses the Platform, including to search or book workspaces.
2.3. "Workspace Provider" / "Space Partner" / "Host" means any individual, company, or entity that lists or offers office spaces, coworking spaces, managed offices, commercial offices, meeting rooms, conference rooms, training rooms, or virtual office services on or through the Platform.
2.4. "Workspace" / "Property" means any physical or virtual office space, including coworking desks, private cabins, managed offices, conventional office spaces, meeting rooms, conference rooms, training rooms, and virtual office solutions listed on the Platform.
2.5. "Agreement" means these Terms, together with the Privacy Policy and any additional agreements, addendums, or written terms executed between OfficeFnD and a User or Workspace Provider.
2.6. "Booking" means any confirmed reservation or arrangement made by a User to use a Workspace, whether short-term or long-term, facilitated through the Platform or via OfficeFnD.
2.7. "Services" means the aggregation, listing, discovery, enquiry, assistance, facilitation, and related services provided by OfficeFnD through the Platform, including but not limited to property search, price negotiation support, documentation support, and/or assistance in concluding lease / license / service agreements between Users and Workspace Providers.

3. Eligibility and Account Registration

3.1. You must be:

(a) at least 18 years of age; and
(b) capable of entering into a legally binding contract under the Indian Contract Act, 1872 to use the Platform and Services.

3.2. If you are registering or acting on behalf of a company, organization, or other legal entity:

(a) you represent and warrant that you have the authority to bind such entity to these Terms; and
(b) "you" and "your" shall refer to that entity.

3.3. To access certain features of the Platform, you may need to create an account by providing accurate, current, and complete information, including your name, email address, phone number, company name, and any other details requested.

3.4. You are responsible for:

(a) maintaining the confidentiality of your login credentials;
(b) all activities that occur under your account; and
(c) informing us immediately of any unauthorized use of your account.

3.5. We reserve the right to refuse registration, suspend, or terminate any account at our discretion, without prior notice, if we believe that:

(a) any information provided is untrue, inaccurate, or incomplete; or
(b) you are in breach of these Terms or applicable laws.

4. Nature of Services and Role of OfficeFnD

4.1. OfficeFnD is an aggregator and facilitator of office and workspace solutions. We provide

1. A platform for Users to:

discover and compare office spaces;
submit enquiries and/or booking requests;
connect with Workspace Providers; and
access assistance for negotiations and documentation (where applicable).

2. A platform for Workspace Providers to:

list and promote their spaces;
receive leads and booking requests; and
potentially receive support in finalizing agreements with Users.

4.2. Unless expressly stated in a specific written agreement:

(a) OfficeFnD is not the owner, lessor, sub-lessor, licensor, or manager of any Workspace listed on the Platform;
(b) OfficeFnD does not provide real estate brokerage as an agent of the User or the Workspace Provider, but acts as a technology-enabled aggregator and facilitator;
(c) the actual agreement for use of the Workspace (lease, license, seat agreement, service agreement, etc.) is solely between the User and the Workspace Provider.

4.3. Any representations, warranties, commitments, or promises related to:

condition or suitability of the Workspace;
pricing, discounts, offers;
facilities, services, or amenities;
compliance with laws and regulations;
are made by the Workspace Provider and not by OfficeFnD, unless explicitly specified in writing by OfficeFnD.

4.4. OfficeFnD may assist in coordination, communication, collection of documents, and sometimes payment facilitation; however, such assistance does not make OfficeFnD a party to the final usage agreement between User and Workspace Provider.

5. Use of the Platform

5.1. You agree to use the Platform only for lawful purposes, in accordance with these Terms and applicable laws of India.

5.2. You agree not to:

Use the Platform for any fraudulent, unauthorized, or illegal activity.
Copy, scrape, or extract data, listings, or content from the Platform without prior written consent.
Circumvent any security features or attempt to gain unauthorized access to any part of the Platform, other accounts, computer systems, or networks.
Upload, transmit, or distribute any viruses, malware, or harmful code.
Post or transmit content that is defamatory, obscene, abusive, infringing, or otherwise objectionable.
Misrepresent your identity, your company, or your association with any person or entity.
Use automated scripts, bots, or other means to access or use the Platform in a manner that may overload or disrupt our systems.

5.3. We may, at any time and without prior notice, modify, suspend, or discontinue any part or all of the Platform or Services for maintenance, upgrades, or any other reason.

6. Workspace Listings and Content

6.1 For Workspace Providers

1. When you list a Workspace on the Platform, you represent and warrant that:

(a) you have full legal right, authority, and permission to offer, list, and allow use of the Workspace;
(b) all information, photos, videos, and descriptions you provide are accurate, up to date, and not misleading;
(c) the Workspace complies with applicable local laws, safety norms, fire regulations, building codes, and other relevant regulations;
(d) you have obtained all necessary approvals, NOCs, licenses, or consents from building owners, societies, or authorities, as required

2. You are solely responsible for:

(a) accuracy of pricing, availability, and features of the Workspace;
(b) honoring confirmed bookings and agreed commercial terms with Users;
(c) dealing with any complaints, disputes, or claims related to your Workspace

3. OfficeFnD may, but is not obligated to, verify any listing, documents, or information. Any verification or "verified" tag does not substitute your legal responsibilities.

4. OfficeFnD reserves the right to:

(a) edit, reject, or remove any listing or content that it deems inaccurate, misleading, inappropriate, or in violation of these Terms;
(b) highlight, feature, or rank listings at its discretion, including based on commercial arrangements.

6.2 For Users

1. Users understand and agree that:

(a) Workspace images, videos, and descriptions are largely provided by Workspace Providers; actual conditions may differ;
(b) OfficeFnD does not guarantee uninterrupted availability or specific suitability of any Workspace for your particular needs;
(c) you should conduct your own due diligence, inspections, and legal review before entering into any binding agreement with a Workspace Provider.

OfficeFnD does not guarantee that:

(a) every listed Workspace is available at all times;
(b) quoted prices are final and error-free; occasional errors or changes may occur.

7. Booking, Enquiries, and Payments

7.1. Enquiry and Shortlisting

1. Users may browse, shortlist, and submit enquiries for Workspaces through the Platform.

2. OfficeFnD or the Workspace Provider may contact the User via phone, email, SMS, WhatsApp, or other communication channels to clarify requirements, arrange site visits, and discuss commercial terms.

7.2. Booking Confirmation

1. A Booking may be considered "confirmed" only when:

(a) the Workspace Provider explicitly accepts and confirms the booking or agreement; and
(b) any required advance, security deposit, or documentation (if applicable) is completed as per the arrangement between User and Workspace Provider.

OfficeFnD is not liable for any claim arising from:

(a) a Workspace Provider refusing or cancelling a booking;
(b) non-availability of the Workspace despite prior discussions.

7.3. Payment Facilitation

1. In some cases, OfficeFnD may facilitate payments (e.g., token amounts, booking deposits, or service fees) on behalf of Workspace Providers through online payment gateways or other channels

2. If OfficeFnD collects monies from a User for a specific Workspace:

(a) such amount is typically held and then remitted to the Workspace Provider, less any agreed fees/charges;
(b) OfficeFnD's responsibility is limited to correctly routing payments as per instructions and is not responsible for underlying Workspace quality or contractual performance.

3. All payment terms, including:

rent / service fee;
security deposit;
lock-in period;
notice period;
penalties and additional charges
are primarily between the User and the Workspace Provider and should be clearly documented in their agreement

7.4. Taxes and Invoices

1. Prices may be:

inclusive or exclusive of applicable taxes (GST or others), as specified by the Workspace Provider.

2. Users are responsible for:

understanding tax implications;
requesting proper tax invoices from Workspace Providers or OfficeFnD (where OfficeFnD is charging a direct fee to the User).

8. Cancellations, Refunds, and No-Show

8.1. Cancellation and refund policies may differ from one Workspace Provider to another.

8.2. It is the responsibility of the User to:

review and understand the specific cancellation, rescheduling, and refund policies communicated by the Workspace Provider or visible on the listing / proposal;
seek clarification before confirming any booking or signing an agreement.

8.3. OfficeFnD:

does not independently determine or guarantee any refunds;
may, at its discretion, assist in mediating disputes but bears no obligation to secure a particular outcome.

8.4. Any refund, if applicable, will be processed as per:

the policy agreed between the User and the Workspace Provider; and
applicable laws and banking/payment gateway timelines.

9. User Obligations at Workspace

9.1. Once a User occupies or uses a Workspace, the User shall:

Use the premises only for lawful business purposes;
Follow all rules, regulations, and policies set by the Workspace Provider, building management, or authorities;
Respect other occupants and maintain decorum, cleanliness, and safety;
Not cause any damage to the premises, furniture, fixtures, or common areas;
Not engage in any illegal or prohibited activities, including but not limited to gambling, illegal trade, or activities that violate intellectual property or other laws;
Comply with security and access procedures (ID checks, visitor logs, etc.).

9.2. Any damage or violation at the Workspace is a matter strictly between the User and the Workspace Provider. OfficeFnD shall not be liable for any:

penalties, fines, or claims;
loss of deposit;
eviction or termination arising from such conduct.

10. Fees, Commissions, and Brokerage

10.1. OfficeFnD may earn:

service fees, convenience fees, platform charges from Users; and/or
commissions, marketing fees, or referral fees from Workspace Providers or third parties.

10.2. The structure, amount, and applicability of such fees may vary depending on:

the type of space (coworking, managed, commercial offices, meeting rooms, virtual offices, etc.);
the city and property;
commercial arrangements with the Workspace Provider or User.

10.3. Where applicable, fees payable by the User will be:

disclosed during the booking process or in a separate commercial proposal; or
communicated directly by OfficeFnD personnel.

10.4. Unless otherwise mentioned, any charges collected by OfficeFnD:

are non-refundable, except as required by law or explicitly agreed otherwise.

10.5. OfficeFnD generally operates on a zero-brokerage promise to Users for discovery and search, but:

this does not prevent OfficeFnD from collecting marketing or referral fees from Workspace Providers;
any exceptions or value-added consulting services that are separately chargeable will be clearly informed.

11. Intellectual Property Rights

11.1. All intellectual property on or related to the Platform, including:

text, graphics, UI/UX elements, logos, trademarks (registered or unregistered), icons, images, software, code, and compilations are owned by or licensed to OfficeFnD, and protected under applicable laws.

11.2. You are granted a limited, non-exclusive, non-transferable, revocable license to:

access and use the Platform solely for your personal or internal business purposes, in accordance with these Terms.

11.3. You shall not:

Copy, reproduce, modify, distribute, sell, or create derivative works based on the Platform or its content, except as expressly allowed in writing.
Use any OfficeFnD trademarks, service marks, or logos without prior written permission.

11.4. Any unauthorized use may lead to legal action, including civil and/or criminal proceedings as per Indian law.

12. User-Generated Content and Feedback

12.1. If you submit any content (reviews, ratings, comments, images, suggestions, feedback, etc.) to the Platform ("User Content"), you:

grant OfficeFnD a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, display, and perform such content in any media.

12.2. You represent and warrant that:

(a) you own or have the necessary rights to submit such content;
(b) such content does not violate any law, contractual obligation, or third-party rights.

12.3. OfficeFnD may moderate, edit, or remove any User Content at its sole discretion, but is not obligated to do so

13. Data Protection and Privacy

13.1. Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data.

13.2. By using the Platform, you consent to:

the collection, storage, processing, and sharing of your information as described in the Privacy Policy.

13.3. OfficeFnD may share User or Workspace Provider information with:

partners, Workspace Providers, payment processors, or service providers when reasonably necessary to:
facilitate bookings;
improve services;
comply with legal obligations; or
prevent fraud and misuse.

14. Third-Party Links and Services

14.1. The Platform may contain links to third-party websites, tools, or services that are not owned or controlled by OfficeFnD.

14.2. OfficeFnD is not responsible for:

content, privacy practices, or services of such third parties;
any transactions or arrangements you enter into with them.

14.3. Accessing third-party links is at your own risk, and you are advised to review their terms and privacy policies separately

15. Disclaimer of Warranties

15.1. The Platform and Services are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied.

15.2. To the maximum extent permitted under applicable law, OfficeFnD disclaims all warranties, including but not limited to:

fitness for a particular purpose;
merchantability;
non-infringement;
accuracy, reliability, or completeness of any listing or content.

15.3. Without limiting the generality of the foregoing, OfficeFnD does not warrant that:

the Platform will be uninterrupted, timely, secure, or error-free;
any Workspace will meet your expectations or specific use requirements;
any defect in software or systems will be corrected immediately.

16. Limitation of Liability

16.1. To the fullest extent permitted by applicable law, OfficeFnD shall

indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, business interruption, loss of data, loss of goodwill, or any other intangible losses arising out of or in connection with:
use of or inability to use the Platform or Services;
any transaction or arrangement between Users and Workspace Providers;
any unauthorised access to or alteration of your data.

16.2. OfficeFnD’s aggregate liability, whether in contract, tort (including negligence), or otherwise, arising out of or in connection with these Terms or your use of the Platform, shall not exceed

the total amount of fees (if any) paid by you to OfficeFnD in the three (3) months preceding the event giving rise to the claim; or
a reasonable nominal cap as may be specified in a separate written agreement (if applicable).

16.3. OfficeFnD shall not be liable for:

acts, omissions, or negligence of Workspace Providers, building owners, or any third parties;
any personal injury, property damage, or other harm occurring at or in relation to any Workspace.

17. Indemnity

17.1. You agree to indemnify, defend, and hold harmless OfficeFnD, its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

Your use of or access to the Platform or Services;
Your violation of these Terms or any applicable law;
Any breach of representations, warranties, or obligations you make hereunder;
Any claim arising from your interaction, agreement, or dispute with any Workspace Provider or other User.

18. Termination and Suspension

18.1. OfficeFnD may, at its sole discretion and without prior notice:

suspend, restrict, or terminate your access to the Platform or Services;
deactivate or delete your account; if we believe you have
violated these Terms;
engaged in fraudulent, abusive, or illegal activity;
created risk or potential legal exposure for OfficeFnD or other Users.

18.2. You may deactivate or request deletion of your account at any time, subject to:

fulfillment of all your obligations and outstanding payments (if any).

18.3. Upon termination:

your right to use the Platform immediately ceases;
certain provisions of these Terms (including intellectual property, limitation of liability, indemnity, and governing law) shall survive termination.

19. Changes to Terms

19.1. OfficeFnD may amend, update, or modify these Terms at any time.

19.2. Updated Terms will be posted on the Platform with a revised “Last Updated” date. Your continued use of the Platform after such changes constitute your acceptance of the updated Terms

19.3. If you do not agree to the revised Terms, you must stop using the Platform.

20. Governing Law and Jurisdiction

20.1. These Terms shall be governed by and construed in accordance with the laws of

20.2. Subject to the arbitration clause (if applicable, see below), the courts located in [City, State – e.g., New Delhi, Delhi] shall have exclusive jurisdiction over any disputes arising out of or in relation to these Terms or your use of the Platform.

21. Dispute Resolution and Arbitration (Optional but Recommended)

21.1. In the event of any dispute, the parties shall first attempt to resolve it amicably through good-faith negotiations.

21.2. If the dispute is not resolved within thirty (30) days, it shall be referred to and finally resolved by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended

21.3. The arbitration:

shall be conducted by a sole arbitrator mutually appointed, or, failing agreement, appointed in accordance with the Act;
seat and venue of arbitration: [City, India];
language of arbitration: English.

21.4. The award of the arbitrator shall be final and binding on the parties.

22. Compliance with Local Laws

22.1. It is your responsibility to ensure that your use of the Platform and Services is in compliance with all applicable local, state, and national laws and regulations in India.

22.2. Workspace Providers are solely responsible for:

compliance with property, municipal, and commercial regulations;
obtaining any registrations, licenses, or permits required to legally operate and offer their Workspaces

23. Force Majeure

23.1. OfficeFnD shall not be liable for any failure or delay in performance of its obligations, if such failure or delay is due to events beyond its reasonable control, including but not limited to:

natural disasters, pandemics, acts of God;
war, terrorism, riots, civil unrest;
government actions or restrictions;
strikes or labour disputes;
Internet or telecommunications failures;
system failures not within its reasonable control.

24. Miscellaneous

24.1. Entire Agreement: These Terms, along with the Privacy Policy and any additional written agreements, constitute the entire agreement between you and OfficeFnD regarding your use of the Platform.

24.2. Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

24.3. No Waiver: Any failure by OfficeFnD to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

24.4. Assignment: You may not assign or transfer your rights or obligations under these Terms without prior written consent from OfficeFnD. We may assign our rights and obligations to any affiliate, successor, or acquirer without restriction.
